Sweepstakes Official Rules

NO PURCHASE NECESSARY. A PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING. Void where prohibited. Sweepstakes begins on or about October 4, 2008 and ends on March 31, 2009 (“Sweepstakes Period”). Porter-Cable Sweepstakes (the “Sweepstakes”) is intended for participation in the continental United States, Alaska, Hawaii or the District of Columbia only and shall be construed and evaluated only according to United States law. Do not proceed in the Sweepstakes website if you are not located in the continental United States, Alaska, Hawaii or the District of Columbia at the time of entry.

Who may enter: Sweepstakes open to legal residents of the 50 United States or the District of Columbia who are 21 years of age or older, as of January 1, 2008. Employees, officers, and directors of Black & Decker (U.S.) Inc. through its Delta|Porter-Cable division (“Sponsor”), their subsidiaries, affiliated companies, dealers, advertising and promotion agencies and those associated with the development, distribution or implementation of this Sweepstakes, their immediate families (including parents, in-laws, siblings, children or spouse, regardless of where they live) and members of the same household, whether related or not, are not eligible to participate.

How to enter: During the Sweepstakes Period, visit www.deltaportercable.com, accurately complete the online account creation form with your name, address, city, state, zip code, daytime phone number, email address, then complete the online product registration form for the product you are registering. Limit one entry per person, or one per email address (regardless of whether one person has more than one email address or more than one person uses the same email address). All entries become the property of the Sponsor and will not be acknowledged or returned, and no correspondence will be entered into. All online entries must be received by 11:59:59 p.m. (ET) on the last day of the month to be eligible for the monthly random drawings. To enter without purchase obligation insert the following code - TS123 - for the product or send a 3X5 card and handprint legibly the form by hand printing your name, company name, address, city, state, zip code, daytime phone number, fax number and email address and mail in a stamped #10 envelope with proper postage affixed to: “Porter-Cable T-Shirt Sweepstakes” Black & Decker (U.S.) Inc., d/b/a Delta|Porter-Cable, c/o 701 E. Joppa Road, TW 395, Towson, Maryland 21286. No photocopies, mechanical reproductions, altered, illegible, garbled, inaudible, incomplete, mutilated, postage-due or forged entries will be accepted. All mail-in entries must be postmarked by the 15th day of each month and received by the second to the last day of the month to be eligible for the monthly drawings. All entries become the property of Sponsor and none will be returned. One entry per person regardless of method. Multiple daily entries submitted by the same person will be disqualified.

Winning: On the first business day of November and the first business day of each month thereafter until May, 2009, potential winners will be determined by monthly random drawings conducted at the Delta|Porter-Cable headquarters. The potential Prize Winner must meet all eligibility requirements set forth in these rules to qualify for prize.

Odds of Winning: Odds of winning depend on the total number of eligible entries received.

Prizes: Fifty (50) Monthly Prizes: Fifty (50) Winners each month will be selected to win a Delta or a Porter-Cable t-shirt, with an approximate retail value of $12.00 each for a total monthly prize value to all winners of $600.00, and the total approximate retail value of all prizes awarded during the Sweepstakes Period to $3,600.00. No cash redemption, substitution or transfer of prize, except at Sponsor’s sole discretion and, if prize becomes unavailable for any reason, Sponsor may award substitute of equal or greater value. All taxes and any other expenses not specified are the responsibility of the winners. The failure to accept a prize within 30 days after the Giveaway shall result in a forfeiture of all prizes awarded hereunder. All unused portions of prizes shall not be redeemable for cash.

Claiming prize: Sponsor will attempt to notify potential winners by mail and/or phone (at Sponsor’s discretion) on the day of each drawing. In the event of noncompliance with these Official Rules, if the entrant does not respond or cannot be contacted at the address associated with his or her entry form within seven (7) days of the drawing, or if the notification is undeliverable, prize will be forfeited and an alternate winner may be selected. Acceptance of prize constitutes permission and a waiver to use, copyright, reproduce, display and publish winner’s name, biographical information, image, photograph, voice and/or likeness by Sponsor and their agents, successors, and assigns for any purpose and in any media whatsoever, whether now known or hereafter developed, throughout the universe in perpetuity, without review or further compensation to entrant. By participating, all entrants acknowledge compliance with and agree to be bound by these Official Rules and the decisions of Sponsor and judges, which are final and binding in all respects. In the event of a dispute as to any registration, the authorized account holder of the email address used to register will be deemed to be the registrant or player. The potential winner may be required to show proof of being the authorized email account holder.

Conditions: Entrants, by participating, release and agree to hold harmless Sponsor and its affiliates, subsidiaries, advertising and promotion agencies and each of their respective directors, officers, employees, representatives and agents from any and all liability for any injuries, losses or damages of any kind to persons, including death, and property, arising in whole or in part, directly or indirectly, from acceptance, possession, use or misuse of a prize, or participation in the Sweepstakes. Neither Sponsor nor any of its respective agencies are responsible for any incorrect or inaccurate information, whether caused by tampering, manipulation, or by any of the equipment or programming associated with or utilized in the Sweepstakes, the unavailability or inaccessibility of any web site or service; unauthorized human intervention in any part of the entry process or the Sweepstakes, electronic or human error which may occur in the administration of the Sweepstakes or the processing of entries; or any injury or damage to persons or property, including but not limited to entrant's computer, which may be caused, directly or indirectly, in whole or in part, from entrant's participation in the Sweepstakes or from downloading any material from Sponsor’s or any other web site(s) related to the Sweepstakes, regardless of whether the material was prepared by Sponsor, or a third party, and regardless of whether the material is connected to Sponsor’s web site by a hypertext link and Sponsor assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, satellite malfunction technical error, theft or destruction or unauthorized access. Sponsor is not responsible for any telephone, computer, or network malfunction or for any computer virus or other damage caused to participant’s computer by accessing Sweepstakes web site(s). Sponsor is not responsible for lost, late, misdirected, illegible, or incomplete entries. Sponsor reserves the right to disqualify any individual it finds to be tampering with the entry process or the operation of the Sweepstakes, to be acting in violation of these Official Rules, or to be acting in a non-sportsmanlike or disruptive manner, or with intent to annoy, abuse, threaten or harass any other person. Any use of robotic, automatic, macro, programmed, third-party or like entry methods will void all such entries by such methods, and disqualify any entrant using such methods. If, for any reason, the Sweepstakes is not capable of running as planned by reason of, but not limited to, tampering, unauthorized intervention, fraud, technical failures, or any other causes which Sponsor, in the sole opinion of Sponsor, deems could corrupt or affect the administration, security, fairness, integrity or proper conduct of this Sweepstakes, Sponsor reserves the right at its sole discretion, to cancel, terminate, modify or suspend the Sweepstakes and select the winners from eligible entries received prior to the action or as otherwise may be deemed fair and equitable by Sponsor. In the event Sponsor terminates the Sweepstakes prior to the end of the Sweepstakes period, it shall post notice thereof at www.deltaportercable.com. All properly claimed prizes will be awarded, but in no event will Sponsor award more prizes than are provided for in these Official Rules.
