Contest Rules

NO PURCHASE NECESSARY TO ENTER. Entries for this “Ultimate Joinery Challenge” (the “Contest”) will be accepted during the period beginning at 12:01 a.m. ET on September 1, 2008 and ending at 11:59 p.m. ET on January 15, 2009 (the “Contest Entry Period”). All entries must be received during the Contest Entry Period.  The Contest is open to legal residents of the continental United States, Alaska, Hawaii and Canada (except Quebec), who are at least 16 years old.  Contest void in Quebec, Puerto Rico and anywhere else where prohibited. 

Participants who are under the age of majority in their state or province must have permission from parent or legal guardian to enter.  Parents and/or legal guardians providing permission agree (i) to supervise the participant to ensure that all woodworking tools are used properly and in a safe manner, and (ii) to be bound by these rules and regulations on the participant’s behalf.

TO ENTER: Participants must individually complete a woodworking project (appropriate supervision excepted), using one of the PORTER-CABLE dovetail jigs. (Models 4210, 4212, 4216, 55160 or 77240)

After completion of their projects, participants must enter their projects at www.deltaportercable.com/ultimatejoinery (the “Website”). At the Website, participants will be required to complete the online entry form, their name, birthday, complete address, daytime phone number, e-mail address, enter a brief description of the project (1,000 character limit), attach four images of the finished project (top view, side view, front view and close-up of joinery used) and one image of participant using a PORTER-CABLE dovetail jig, and submit the completed online entry form. Images need to be at least 3”x3” @ 300dpi.  All entries become the property of the Sponsor (hereinafter defined) and will not be returned. Entries are limited to one per email address per residential household.  Multiple participants are not permitted to share the same email address.  Any attempt by any participant to obtain more than the stated number of entries by using multiple/different email addresses, identities, registrations and logins, or any other methods will void that participant's entries and that participant may be disqualified.  Use of any automated system to participate is prohibited and will result in disqualification.  In the event of a dispute as to any registration, the authorized account holder of the email address used to register will be deemed to be the registrant.  The “authorized account holder” is the natural person assigned an email address by an Internet access provider, online service provider or other organization responsible for assigning email addresses for the domain associated with the submitted address.  A potential winner may be required to show proof of being the authorized account holder.
 

All Participants must comply with these Official Rules. The Website is governed by the DELTA|Porter-Cable Privacy Policy, which is available at the Website. 

All entries will be reviewed by the Sponsor before being published or judged; however, such review does not relieve participants from the responsibility of complying with these Official Rules. Entries that do not comply with these Official Rules as determined by the Sponsor, in its sole discretion, will be disqualified and will not be published or considered for the Finalist Gallery (hereinafter defined) and/or any prizes. Sponsor makes the final determination as to which entries are eligible to take part in the Contest and be considered for the Finalist Gallery and/or any prizes. From time to time during the Contest Entry Period, Sponsor may, in its sole discretion, choose to feature some of the submitted projects on the DELTA | PORTER-CABLE website. Being featured on the DELTA | PORTER-CABLE website is unrelated to the Judging Criteria (hereinafter defined) and in no way reflects the possibility of the entry being selected for the Finalist Gallery.

Sponsor is not responsible for unavailable networks, failed server or other connections, miscommunications, interrupted, misrouted or scrambled transmissions or other errors or problems of any kind whether mechanical, human, electronic or otherwise. The Sponsor assumes no responsibility for lost, stolen, delayed, damaged or misdirected entries or for any failure of the Website during the Contest period, for any problems or technical malfunction of any telephone network or lines, computer on-line systems, access providers, computer equipment, software, failure of any e-mail entry to be received by Sponsor due to technical problems or traffic congestion on the Internet or at any website, of any combination thereof, or for any injury or damage to a participant’s or any other person’s computer related to or resulting from playing or downloading any material related to the Contest. Sponsor reserves the right, in its sole discretion, to cancel or suspend the Contest should a virus, bug or other cause beyond the reasonable control of the Sponsor corrupt the security or proper administration of the Contest. Any attempt to deliberately damage any website or to undermine the legitimate operation of the Contest may be a violation of criminal and civil laws, and should such an attempt be made, Sponsor reserves the right to seek remedies and damages to the fullest extent permitted by law, which may include criminal prosecution. Entries are subject to verification and will be declared invalid if they are illegible, forged, falsified, altered or tampered with in any way. The Contest Rules are subject to the interpretation of the Sponsor, and all decisions related thereto are final.

PRIZES/VALUES:
1ST PRIZE:   Voucher for $3,000.00 U.S. retail value of Porter Cable and Delta tools
2ND PRIZE:   Voucher for $1,500.00 U.S. retail value of Porter Cable and Delta tools
3RD PRIZE:   Voucher for $750.00 U.S. retail value of Porter Cable and Delta tools

 

Vouchers are redeemable for Porter Cable | Delta tools of the winner’s choice, subject to availability of such tools.  Sponsor reserves the right to substitute any tools of equal or greater value for chosen tools.  Winners may be subject to certain withholding tax requirements under US and Canadian law.  Winners are responsible for payment of all taxes, including any withholding or income tax as a result of claiming a prize hereunder.

ALL PRIZES CONTAIN WOODWORKING TOOLS AND/OR EQUIPMENT. ANYONE USING SUCH TOOLS AND/OR EQUIPMENT (INCLUDING MINORS) SHOULD PRIOR TO USE READ AND UNDERSTAND THE MANUALS AND LEARN THE PROPER OPERATING TECHNIQUES. MINORS SHOULD ONLY OPERATE SUCH TOOLS UNDER THE SUPERVISION OF AN ADULT. THE IMPROPER USE OF SUCH TOOLS AND/OR EQUIPMENT COULD RESULT IN SERIOUS PERSONAL INJURY OR DEATH.

The total approximate retail value of all the prizes is: $5,250.00 U.S. 


TERMS/CONDITIONS: All federal, state/provincial and local laws and regulations apply. Void where prohibited. Prizes are non-transferable and not redeemable for cash. Each winner will be responsible for all applicable federal, state/provincial, and local taxes related to any prize. Sponsor shall not be responsible for any unsuccessful attempts to notify the potential winners. Employees, officers, and contractors (including immediate family members and members of the same household) of Sponsor, its affiliated companies, subsidiaries, distributors, dealers, retailers, vendors of Sponsor, and all other entities associated with this Contest, are not eligible. Each participant agrees to release and hold the Sponsor, its subsidiaries, parent companies, or other affiliated companies and their respective employees, officers, directors, shareholders, agents, and representatives, harmless from any and all damages, losses, claims and/or liabilities arising out of his or her participation in the Contest or resulting from accepting, using or claiming any prize awarded hereunder. Unless indicated otherwise by checking the opt-out box on the Website, participants acknowledge and agree that Sponsor may share personal information collected through the Contest from time to time with its subsidiaries, parent companies and affiliated companies, and that such information shall be used to contact participants for advertising and promotional purposes.

Notwithstanding the foregoing paragraph, participation in the Contest constitutes permission (except where prohibited by law) for the Sponsor to use any winner’s name, likeness, biographical information, photographs and any statements or remarks made about winning or participating in the Contest for advertising, educational and promotional purposes (in any medium) without additional compensation. IF YOU DO NOT WISH TO GRANT SUCH PERMISSION, DO NOT ENTER THE CONTEST.

WINNING: Judging Criteria. Among all qualified entries received, the judging organization (the “Judges”) shall select the top ten (10) entries, based on the criteria listed below, on or about January 20, 2009.

Entries shall be judged subjectively as follows:
a. Quality of Design 50% (includes general aesthetics, design and artistic impression)
b. Craftsmanship 50% (includes review of construction and techniques used)

The top ten (10) entries selected by the Judges shall be the “Finalists” and will have their projects displayed on the Website (the “Finalist Gallery”) where consumers may cast their votes (see Consumer Voting paragraph below). All decisions by the Judges shall be final and binding. It is the sole decision of the Judges to determine which entries will be included in the Finalist Gallery.

Consumer Voting: The ten (10) Finalist projects chosen by the Judges will be uploaded to the Finalist Gallery on the DELTA|PORTER-CABLE Website. Based on the Judging Criteria, consumers will be allowed to vote on their favorite piece to choose the winners of the Contest. The voting will take place during the time period commencing February 1, 2009 at 10:00 a.m. ET and ending February 15, 2009 at 11:59 p.m. ET (the “Consumer Voting Period”). The voting portion of this Contest is open to consumers who are 16 years of age or older at the time of voting and have a valid e-mail address. There is a limit of one (1) vote per consumer per e-mail address per day during the Consumer Voting Period.

 

The number of votes each Finalist receives will be tallied and the Finalist who receives the most votes will be awarded the First Prize. The Finalist who receives the second highest number of votes will be awarded Second Prize and the Finalist with the fewest votes will be awarded Third Prize. Any ties shall be decided by the Judges. Winners will be announced on the Website on or about February 27, 2009.

There will be one First Prize winner, one Second Prize winner and one Third Prize winner. No more than the advertised number of prizes will be awarded. Winners will be notified within 14 days of selection by telephone, mail or email. One prize per person, household, or family.

CLAIMING PRIZES: Each winner must sign and return an Affidavit of Eligibility and Liability/Publicity Release and provide proof of age within thirty (30) days of notification, or his or her prize may be forfeited (except where prohibited by law). Prizes will be delivered to each winner’s residence within thirty (30) days of receiving the Affidavit of Eligibility and Liability/Publicity Release. If a prize is won by a participant that has not reached the age of majority within his or her state or providence of residence (i) his or her parent or legal guardian must complete, sign and return on behalf of the participant the Affidavit of Eligibility, Liability/Publicity Release, and provide proof of age within (30) days, or his or her prize may be forfeited, and (ii) the prize will be awarded in the minor’s name and delivered to his or her parent or legal guardian’s residence. .
